EULA - End User License Agreement

Submit Machine GO! SOFTWARE END USER LICENSE AGREEMENT
IMPORTANT: THIS SOFTWARE END USER LICENSE AGREEMENT ("EULA") IS A LEGAL AGREEMENT BETWEEN YOU AND Submit Machine GO!. READ IT CAREFULLY BEFORE COMPLETING THE INSTALLATION PROCESS AND USING THE SOFTWARE. IT PROVIDES A LICENSE TO USE THE SOFTWARE AND CONTAINS WARRANTY INFORMATION AND LIABILITY DISCLAIMERS. BY INSTALLING AND USING THE SOFTWARE, YOU ARE CONFIRMING YOUR ACCEPTANCE OF THE SOFTWARE AND AGREEING TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, THEN SELECT THE "NO" BUTTON, DO NOT INSTALL THE SOFTWARE AND RETURN THE SOFTWARE TO YOUR PLACE OF PURCHASE FOR A FULL REFUND.

LICENSE
This EULA allows you to:
(a) Install and use the Submit Machine GO! software on a single computer; OR install and store the Submit Machine GO! software on a storage device, such as a network server, used only to install the Submit Machine GO! software on your other computers over an internal network, provided you have a license for each separate computer on which the Submit Machine GO! software is installed and run. A license for the Submit Machine GO! software may not be shared or used concurrently on different computers.
(b) Make one copy of the Software in machine-readable form solely for backup purposes. You must reproduce on any such copy all copyright notices and any other proprietary legends on the original copy of the Submit Machine GO! software.

LICENSE RESTRICTIONS
(a) You may not make or distribute copies of the Submit Machine GO! Software.
(b) You may not decompile, reverse engineer, disassemble, or otherwise reduce the Submit Machine GO! software to a human-perceivable form.
(c) You may not rent, lease, or sublicense the Software.
(d) You may permanently transfer all of your rights under this EULA only as part of a sale or transfer, provided you retain no copies, you transfer all of the Submit Machine GO! Software (including all component parts, the media and printed materials, any upgrades, this EULA, and the serial numbers), and the recipient agrees to the terms of this EULA. If the Submit Machine GO! software is an upgrade, any transfer must include all prior versions of the Software. You may not sell or transfer any Submit Machine GO! software purchased under a volume discount.
(e) You may not modify the Submit Machine GO! software or create derivative works based upon the Submit Machine GO! software.
(f) In the event that you fail to comply with this EULA, Submit Machine GO! may terminate the license and you must destroy all copies of the Submit Machine GO! software.

OWNERSHIP
The foregoing license gives you limited license to use the Submit Machine GO! software. Its suppliers retain all right, title and interest, including all copyrights, in and to the Submit Machine GO! software and all copies thereof. All rights not specifically granted in this EULA, including International Copyrights, are reserved by Submit Machine GO! software and its suppliers.

LIMITED WARRANTY AND DISCLAIMER
To the maximum extent permitted by applicable law, Submit Machine GO! and its suppliers provide the Product AS IS AND WITH ALL FAULTS, and hereby disclaim all warranties and conditions, either express, implied or statutory, including, but not limited to, any (if any) implied warranties or conditions of merchantability, of fitness for a particular purpose, of lack of viruses, of accuracy or completeness of responses, of results, and of lack of negligence or lack of workmanlike effort, all with regard to the Product. ALSO,THERE IS NO WARRANTY OR CONDITION OF TITLE, QUIET ENJOYMENT, QUIET POSSESSION, CORRESPONDENCE TO DESCRIPTION OR NON-INFRINGEMENT, WITH REGARD TO THE PRODUCT. THE ENTIRE RISK AS TO THE QUALITY OF OR ARISING OUT OF USE OR PERFORMANCE OF THE PRODUCT AND SUPPORT SERVICES, IF ANY, REMAINS WITH YOU.

EXCLUSION OF INCIDENTAL, CONSEQUENTIAL AND CERTAIN OTHER DAMAGES.
To the maximum extent permitted by applicable law, in no event shall Submit Machine GO! or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits or confidential or other information, for business interruption, for personal injury, for loss of privacy, for failure to meet any duty including of good faith or of reasonable care, for negligence, and for any other pecuniary or other loss whatsoever) arising out of or in any way related to the use of or inability to use the Product, the provision of or failure to provide Support Services, or otherwise under or in connection with any provision of Agreement, even in the event of the fault, tort (including negligence), strict liability, breach of contract or breach of warranty of Submit Machine GO! or any supplier, and even if Submit Machine GO! or any supplier has been advised of the possibility of such damages.

LIMITATION OF LIABILITY AND REMEDIES.
Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced above and all direct or general damages), the entire liability of Submit Machine GO! and any of its suppliers under any provision of this Agreement and your exclusive remedy for all of the foregoing shall be limited to the greater of the amount actually paid by you for the Product. The foregoing limitations, exclusions and disclaimers shall apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose.

SUPPORT
Submit Machine GO! is not obligated to provide technical or other support for the Product.
